1. Acceptance of Terms
These Terms of Use (“Terms”) govern your access to and use of the mobile application Grounded: Daily Affirmations (“Grounded,” “we,” “us,” or “our”), developed and operated by BPA TARGET SRL.
By downloading, installing, or using the application, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree with these Terms, you must not use the application.
The application is made available through the Apple App Store and may also be subject to Apple’s terms and policies where applicable.
2. Description of the Service
Grounded is a personal development application that provides affirmations and allows users to personalize preferences and track their experience locally on their device.
Grounded is not a medical, psychological, therapeutic, or healthcare service.
The content provided within the application is intended for informational and personal development purposes only and does not replace professional advice.
You acknowledge that you are solely responsible for how you interpret and use the content provided within the application.
3. Eligibility
The application is intended for individuals aged 18 years or older.
By using the application, you confirm that you meet this age requirement and have full legal capacity to enter into binding agreements under applicable law.
4. Account and Local Data
Grounded does not require account registration.
All user-generated content remains stored locally on the user’s device. We do not host user content on our servers.
You are solely responsible for maintaining the security of your device and any data stored on it.
5. Subscriptions and Payments
Grounded offers optional auto-renewable subscription plans processed exclusively through Apple’s App Store.
Subscriptions may include:
• Monthly subscription plans
• Yearly subscription plans
Certain subscriptions may include a free trial period. If the trial is not canceled before its expiration, the subscription automatically converts into a paid subscription.
Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period.
Payment will be charged to your Apple ID account at confirmation of purchase.
You may manage or cancel subscriptions through your Apple account settings.
We do not have access to your full payment details. All billing and payment processing is handled by Apple in accordance with its own policies.
We reserve the right to introduce additional subscription tiers in the future, including lifetime access or other premium offerings.
6. Intellectual Property
All content within the application is the exclusive property of BPA TARGET SRL and is protected by applicable intellectual property laws.
This includes but is not limited to:
• Text and affirmations
• Graphics and design elements
• Logos
• Software and interface elements
You are granted a limited, non-exclusive, non-transferable, revocable license to use the application for personal, non-commercial purposes.
You may not copy, reproduce, distribute, modify, reverse engineer, or create derivative works based on the application without prior written consent.
7. Sharing Content
The application may allow users to share selected content externally (for example affirmation screenshots).
You may share such content for personal, non-commercial purposes provided that:
• The content is not modified in a misleading way
• Attribution to Grounded remains visible where applicable
Shared content may not be used for commercial exploitation, resale, redistribution as a standalone product, or misleading representation.
8. Prohibited Conduct
You agree not to use the application:
• In any unlawful or fraudulent manner
• To harm other users
• To interfere with the proper functioning of the application
• To bypass subscription mechanisms
• To exploit technical vulnerabilities
Any violation of these Terms may result in suspension or termination of access without prior notice.
9. Termination
You may stop using the application at any time by uninstalling it.
We reserve the right to suspend or terminate access if you violate these Terms or engage in conduct that may harm the application or its users.
10. Disclaimer of Warranties
The application is provided on an “as is” and “as available” basis.
We do not guarantee that the application will be uninterrupted, secure, error-free, or free from technical defects.
To the maximum extent permitted by law, we disclaim all warranties, express or implied.
11. Limitation of Liability
To the maximum extent permitted by applicable law, BPA TARGET SRL shall not be liable for indirect, incidental, consequential, or special damages arising from the use of the application.
Our total liability for any claim shall not exceed the amount paid by you for subscriptions during the previous twelve (12) months.
12. Indemnification
You agree to indemnify and hold harmless BPA TARGET SRL from claims or damages arising from:
• Misuse of the application
• Violation of these Terms
• Violation of applicable laws or third-party rights
13. Changes to the Service and Terms
We reserve the right to modify, suspend, or discontinue any part of the application at any time.
We may update these Terms periodically. The most recent version will always indicate the revision date.
Continued use of the application after updates constitutes acceptance of the revised Terms.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of Romania.
Any dispute arising from these Terms shall fall under the jurisdiction of the competent courts in Romania.
If you are a consumer residing in the European Union, mandatory consumer protection provisions of your country of residence may apply where required by law.
